Privacy policy – Law District - Chao Legal - Legal Skill Academy 
(English translation below)

Law District B.V., handelend onder de handelsnamen “Chao Legal” en “Legal Skill Academy” (hierna gezamenlijk en afzonderlijk aangeduid als: “Law District”), respecteert uw persoonsgegevens en draagt er zorg voor dat de persoonlijke informatie die aan ons wordt verstrekt of anderszins verkrijgen vertrouwelijk wordt behandeld. Bij persoonsgegevens gaat het om alle informatie over een persoon. Ook gegevens die indirect iets over iemand zeggen, zijn persoonsgegevens. Met het onderstaande wordt uitvoering gegeven aan de in de AVG neergelegde informatieplicht aan de betrokkene(n) wiens persoonsgegevens Law District verwerkt.

Verwerkingsverantwoordelijke en communicatie

Law District verwerkt persoonsgegevens om diensten aan te kunnen bieden, dienstverlening te kunnen verbeteren en om persoonlijk met u als betrokkene te kunnen communiceren. Voor evaluatie van onze dienstverlening schakelt Law District veelal een derde partij in. U als betrokkene maakt zelf de keuze hieraan deel te nemen en daarvoor persoonsgegevens achter te laten. Ook kunt u zich via (een van) de websites van www.chaolegal.nl en/of www.legalskillacademy.com (hierna: de “Website(s)”) aanmelden voor het ontvangen van een nieuwsbrief of andere vormen van communicatie-uitingen van Law District.

Doel verwerking persoonsgegevens

Law District verwerkt de hierna genoemde persoonsgegevens uitsluitend voor de hierna te noemen doeleinden:

  • Cliënt-acceptatieprocedure
  • Het verlenen van juridische diensten, waaronder de uitvoering van een overeenkomst en het voeren van (gerechtelijke) procedures
  • Versturen en innen van declaraties
  • Advisering, bemiddeling en verwijzing
  • Voldoen aan onze juridische en wettelijke verplichtingen, zoals de Wwft
  • Marketing- en communicatie-activiteiten (zoals het versturen van een nieuwsbrief)
  • Werving en selectie (sollicitatie)
  • Het geven van (online of offline) juridische trainingen
  • Het verkrijgen van anonieme website-statistieken (zoals bezoekersaantallen)

Welke persoonsgegevens worden verwerkt

Law District verwerkt de navolgende (soorten of categorieën) persoonsgegevens ten behoeve van de dienstverlening of die door betrokkene vanuit eigen initiatief zijn verstrekt:

  • Voornaam
  • Achternaam
  • Voorletters
  • Geslacht
  • Functietitel
  • (Mobiele) telefoonnummer
  • (Zakelijk) e-mailadres
  • (Zakelijk) postadres
  • KvK-nummer (in het geval van een VOF of eenmanszaak)
  • Gegevens over uw vraag/zaak
  • BTW-nummer
  • Kopie ID-bewijs (indien nodig)
  • Correspondentiegegevens
  • Cursusgegevens (indien toepasselijk)
  • Financiële gegevens (bankrekeningnummer, facturatiegegevens, betalingshistorie)

Voornoemde persoonsgegevens verwerkt Law District omdat deze door u als betrokkene op eigen initiatief zijn verstrekt, in het kader van de dienstverlening zijn verkregen, door derde partijen aan ons kenbaar zijn gemaakt, waaronder wederpartijen, of via openbare bronnen bekend zijn geworden. 

Grondslag verwerking persoonsgegevens

Law District verwerkt de hierboven genoemde persoonsgegevens uitsluitend op basis van de hierna te noemen gronden als bedoeld in artikel 6 van de AVG:

  • wettelijke verplichting
  • uitvoering van een overeenkomst
  • verkregen toestemming van betrokkene(n), in welk geval u uw toestemming op elk gewenst moment kunt intrekken
  • gerechtvaardigd belang 

Bewaartermijn

In overeenstemming met de AVG en de overige relevante wetgeving, bewaart Law District de persoonsgegevens niet langer dan noodzakelijk is voor de verwezenlijking van de doeleinden waarvoor zij verzameld of verwerkt worden. De bewaartermijn van cliëntendossiers en de gegevens omtrent de online trainingen bedraagt in principe 7 jaar na de afronding van het laatste dossier, de laatste cliënt-communicatie of afronding van een (online) training, tenzij dit op grond van de wet of in geval van (bijvoorbeeld) een (potentieel) conflict langer dient te worden bewaard.

Delen van persoonsgegevens met derden

Law District deelt uw persoonsgegevens alleen met derde partijen voor zover noodzakelijk voor de dienstverlening met inachtneming van de hiervoor genoemde doeleinden. Hierbij valt te denken aan waarneming van de praktijk door een andere advocaat, het (laten) uitvoeren van een deskundigheidsonderzoek of het inschakelen van een andere derde partij namens en in opdracht van Law District, zoals een IT-leverancier, maar ook het verstrekken van uw persoonsgegevens in verband met (gerechtelijke) procedures of correspondentie met de wederpartij.

Daarnaast kan Law District persoonsgegevens verstrekken aan een derde partij, zoals een toezichthouder of een andere met openbaar gezag beklede instantie, voor zover daartoe een wettelijke verplichting bestaat.

Met de derde partij die namens en in opdracht van Law District uw persoonsgegevens verwerkt, wordt een verwerkersovereenkomst gesloten waardoor die derde partij eveneens gehouden is tot naleving van de AVG. Door Law District ingeschakelde derde partijen, die als verwerkingsverantwoordelijke diensten aanbieden, zijn voor de (verdere) verwerking van uw persoonsgegevens zelf verantwoordelijk voor de naleving van de AVG. Hierbij valt te denken aan een accountant, notaris, ingeschakelde andere derde partij ten behoeve van een second opinion of deskundigenrapport.   

Beveiliging persoonsgegevens

Law District hecht grote waarde aan de beveiliging en bescherming van uw persoonsgegevens en zorgt, rekening houdend met de stand van de techniek, voor passende technische en organisatorische maatregelen om een op het risico afgestemd beveiligingsniveau te waarborgen. In het geval Law District gebruik maakt van diensten van derde partijen, zoals een IT-leverancier, zal Law District in het kader van de bescherming van persoonsgegevens in een verwerkersovereenkomst afspraken vastleggen over afdoende beveiligingsmaatregelen.

Uw rechten

Een verzoek tot inzage, correctie, beperking, verzet, overdraagbaarheid van gegevens, verwijdering van uw persoonsgegevens of intrekking van eerder gegeven toestemming, kunt u sturen via onderstaande contactgegevens. U ontvangt binnen een maand na ontvangst van uw verzoek nader bericht van ons.

Er kunnen zich omstandigheden voordoen waarbij Law District aan uw verzoek als betrokkene geen of niet volledige uitvoering kan geven. Hierbij valt te denken aan de geheimhoudingsplicht van advocaten en wettelijke bewaartermijnen.

Teneinde zeker te weten dat wij op basis van uw verzoek de betreffende persoonsgegevens aan de juiste persoon verstrekken, kunnen wij u ter verificatie een aantal verificatievragen stellen, dan wel (indien noodzakelijk) vragen zich in persoon (of via een online vergadering) te legitimeren. Law District neemt alleen verzoeken in behandeling die betrekking hebben op uw eigen persoonsgegevens.

Gebruik social media

Op de Website(s) van Law District (www.chaolegal.nl en www.legalskillacademy.com) zijn knoppen (ook wel buttons genaamd) en/of links opgenomen om webpagina’s te kunnen promoten of delen op sociale (media) netwerken of websites van derden, zoals Twitter, Linkedin of Facebook. Law District houdt geen toezicht op en is niet verantwoordelijk voor de verwerking van uw persoonsgegevens door en via zulke derde partijen. Het gebruik van die media is dus voor uw eigen risico. Voordat u van die diensten van derde partijen gebruik maakt, is het raadzaam eerst het privacy statement van die derden door te lezen.

Statistieken en cookies

De Websites van Law District maken gebruik van contactformulieren en Google Analytics. Google Analytics maakt gebruik van analytische cookies. Dit zijn cookies (kleine tekstbestanden) die op uw computer worden geplaatst, waarin bepaalde gegevens worden vastgelegd - zoals een website die u bezoekt - om gebruikersstatistieken te bepalen. Als u de Websites van Law District bezoekt, ziet u een banner onder de Websites, waarin het gebruik van noodzakelijke en analytische cookies wordt onthuld.

Cookies zijn ingesteld in een privacy-vriendelijke modus

De cookies van Google Analytics (voor zover ze worden toegepast op de Websites) zijn in een privacy-vriendelijke modus ingesteld, wat betekent dat alleen niet-herleidbare gegevens worden verzameld zoals: geanonimiseerd IP-adres (Dit betekent dat het laatste octet van het IP-adres is geanonimiseerd, de zogenaamde 'IP anonimiseren'), technische details (bijvoorbeeld: welke browser wordt gebruikt, de resolutie van het computerscherm), welke pagina's worden bezocht op de Websites van Law District en vanaf welke websites of zoekmachine de Websitebezoeker in Law District terecht is gekomen.

De mogelijkheid om gegevens te delen met Google is uitgeschakeld. Law District maakt geen gebruik van andere Google Analytics-cookies.

Law District B.V., a private limited liability company incorporated under the laws of the Netherlands, having its corporate seat in Amsterdam, and having its offices at Strawinksylaan 4117, 1077 ZX, Amsterdam, also acting under the trade names “Chao Legal” and “Legal Skill Academy” (hereafter: “Law District”) respects your privacy. Law District cannot render its services without processing certain of your (personal) data. Law District therefore applies a privacy policy that is applicable to its Websites www.chaolegal.nl and www.legalskillacademy.com (hereafter: “Websites”) and - if applicable - to all personal data that Law District processes when providing its (legal) services. Law District acts in compliance with the General Data Protection Regulation (GDPR). In this privacy policy, you will read what personal data Law District will (potentially) process, for which purposes and in which way.

Which personal data?

If you fill in the contact form on the Websites of Law District (on the Websites www.chaolegal.nl or www.legalskillacademy.com), or request services from Law District by any other means (by telephone, regular mail, in person or otherwise), you are requested to provide the following personal data, for the client acceptance procedure:

  • First and last name;
  • Email address;
  • Business address;
  • (Business) telephone number;
  • (Business) mobile number;
  • Details about your case;
  • Chamber of Commerce number
  • Copy ID (only in case of acceptance of a new client, if needed);
  • VAT number;
  • Bank account details
  • Correspondence 

For which purpose?

  • for the client acceptance procedure;
  • to comply with applicable rules and regulations;
  • to perform (legal) services by Law District;
  • to prepare and send invoices;
  • marketing and communication activities, such as sending a newsletter;
  • recruitment and HR activities (in case of job applicants)
  • to prepare and give (online and offline) legal trainings;
  • to obtain (anonymous) Websites usage statistics, to improve the Websites of Law District.

Legal basis

Law District processes the above-mentioned personal data exclusively on the basis of the following legal grounds as referred to in Article 6 of the GDPR:

  • legal obligation
  • execution of an agreement
  • obtained permission from the person (s) involved
  • legitimate interest

Retention period

In accordance with the GDPR and other relevant legislation, Law District does not store the personal data longer than necessary for the realization of the purposes for which they are collected or processed. The retention period of client files and the data regarding the online training courses is in principle 7 years after the completion of the last case, the last client communication or completion of an (online) training, unless it is required to retain the data for a longer period by law or in case of (for example) a (potential) conflict.

Sharing of personal data with third parties

Law District only shares your personal data with third parties to the extent necessary for the provision of services with due observance of the aforementioned purposes. This could include the observation of the practice by another lawyer, the performance of an expertise investigation or the engagement of another third party on behalf of Law District, such as an IT-supplier, but also the provision of your personal data in connection with (legal) proceedings or correspondence with the other party.

In addition, Law District may provide personal data to a third party, such as a supervisory authority or other governmental body with public authority, insofar as there is a legal obligation to do so.

A data processing agreement is concluded with the third party that processes your personal data on behalf of Law District, whereby that third party is also obliged to comply with the GDPR. Third parties engaged by Law District, who offer services as controller, are themselves responsible for compliance with the GDPR for the (further) processing of your personal data. This could include an accountant, civil-law notary, or another third party engaged for a second opinion or expert report.

Security of personal data

Law District attaches great value to the security and protection of your personal data and, taking into account the state of the art, takes appropriate technical and organizational measures to ensure a level of security appropriate to the risk. In the event that Law District uses services from third parties, such as an IT-supplier, Law District will enter into agreements about adequate security measures in a data processing agreement in the context of the protection of personal data.

Use of social media

On the Website(s) of Law District (www.chaolegal.nl and www.legalskillacademy.com) certain social media buttons and/or links are included to promote or share web pages on social (media) networks or websites from third parties, such as Twitter, Linkedin or Facebook. Law District does not supervise and is not responsible for the processing of your personal data by and through such third parties. The use of those media is therefore at your own risk. Before using those services of third parties, it is advisable to first read the privacy statement of those third parties.

Statistics and cookies

The Websites of Law District are making use of contact forms and Google Analytics. Google Analytics is making use of analytical cookies. These are cookies (small text files) placed on your computer, in which certain data are recorded - such as a Websites you are visiting - in order to determine user statistics. If you visit the Websites of Law District, you will see a banner below the Websites, in which the use of necessary and analytical cookies is being disclosed.

Cookies have been set in a privacy friendly mode

The cookies of Google Analytics have been set in a privacy-friendly modus, which means that only certain non-traceable data are collected such as: anonymized IP-address (This means that the last octet of the IP-address has been anonymized, the so-called 'Anonymize IP'), technical details (for example: what browser is used, the resolution of the computer screen), what pages are visited on the Websites of Law District and from what Websites the Websites visitor arrived at Law District.

The possibility of sharing data with Google has been switched off. Law District does not make any use of other Google Analytics cookies.

Your rights

You can send a request for access, correction, limitation, opposition, transfer your data, deletion of your personal data or withdrawal of previously given consent via the contact details below. You will receive further notice from us within one month of receipt of your request.

There may be circumstances in which Law District cannot or cannot (fully) comply your (data subject) request. This includes the duty of confidentiality of lawyers and statutory retention periods.

In order to ensure that we provide the relevant personal data to the correct person on the basis of your request, we can ask you a number of verification questions, or (if necessary) ask you to identify yourself in person (or via an online meeting). Law District will only process requests that relate to your own personal data.
